Who’s to Blame When AI Agents Screw Up?

As agentic AI systems grow more sophisticated and autonomous, developers and legal experts alike are grappling with a central concern: who is responsible when these AI agents make mistakes? Companies like Microsoft, Google, and Amazon are racing to build multi-agent AI frameworks capable of performing complex tasks independently, with limited human oversight. While this shift promises efficiency and cost savings, it introduces significant legal and ethical ambiguities. 

Jay Prakash Thakur, a Microsoft engineer and independent AI developer, has been experimenting with Microsoft’s AutoGen and other agent development tools. His multi-agent prototypes demonstrate both potential and risk. In one example, a summarization agent omitted a critical condition while parsing service terms, potentially leading another AI to misuse third-party software. In another case, an ordering system misinterpreted “onion rings” as “extra onions,” showing how small errors could pose safety risks, particularly in industries like food service or healthcare. 

The legal implications are murky. Joseph Fireman, senior legal counsel at OpenAI, noted that in disputes involving AI mishaps, lawsuits typically target large tech firms with deep pockets, regardless of where the fault originated. Liability becomes even more complex when AI agents from multiple providers interact. 

To mitigate these risks, some experts advocate for “judge” agents—meta-AIs that monitor and correct the actions of other agents before errors escalate. Others, like AI strategist Mark Kashef, warn against over-engineering systems with excessive agents that resemble bureaucratic bloat. 

Legal scholars urge clear contracts and accountability frameworks that assign responsibility for agentic behavior, especially in commercial applications. As AI agent usage increases, businesses must balance automation with strong oversight, security protocols, and transparency to ensure reliability and prevent unintended harm. 

In short, while agentic AI offers transformative potential, human accountability remains essential in safeguarding its integration into real-world systems.
